Gabon’s Council of Ministers has approved legislation to ratify the BEPS multilateral instrument, which Gabon signed on June 7, 2017. Developed through negotiations among over 100 countries and jurisdictions, the BEPS MLI allows nations to amend their existing tax treaties to incorporate measures from the OECD/G20 BEPS project without the need for individual renegotiations. This instrument aims to establish minimum standards to combat treaty abuse, prevent the artificial avoidance of permanent establishment status, enhance dispute resolution mechanisms, and address the effects of hybrid mismatch arrangements.
The BEPS MLI will take effect for Gabon's treaties on the first day of the fourth month after the country submits its instrument of ratification to the OECD. Therefore, if Gabon ratifies the agreement in June, it will become effective on October 1, 2025.
